1. Acceptance of Terms
By accessing or using BandBliss ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these terms.
2. Eligibility and Accounts
You must be at least 13 years old to create a BandBliss account. Organizations may keep records about members who are minors, but the account holder entering that information must be an adult, and the organization is responsible for obtaining parental or guardian consent before adding personal information about anyone under 18. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.
3. Use of Service and Acceptable Use
BandBliss provides ensemble management software for music organizations. You may use the Service only for lawful purposes and in accordance with these Terms.
The Service includes email tools that send messages on your organization's behalf. You agree to use them only to contact people who have a genuine relationship with your ensemble, such as members, patrons, invited guests, and audition applicants. Sending unsolicited bulk email, circumventing unsubscribe preferences, or using the Service to harass anyone is prohibited and may result in suspension.
4. Organizations and Member Data
Each organization on BandBliss is controlled by its owner and administrators. The organization is responsible for the actions of its administrators and for the accuracy of the information they enter.
Member records may include personal information such as contact details, dates of birth, emergency contacts, and medical or dietary notes. By entering this information, your organization confirms that it has each member's consent (or a parent or guardian's consent for minors) to store it in the Service.
Organizations may choose to publish member names, photos, and biographies on their public page. Before doing so, your organization confirms that it has the consent of the members shown.
5. Uploaded Content and Copyright
You retain ownership of the content you upload to BandBliss, including sheet music files, documents, photos, and receipts. By uploading content, you warrant that you own it or hold the necessary rights and licenses to store and share it through the Service. This applies in particular to sheet music: uploading scores or parts you do not have the right to reproduce is a violation of these terms.
We may remove content that we reasonably believe infringes someone else's rights, and we may suspend accounts that repeatedly upload infringing material.
If you believe content hosted on BandBliss infringes your copyright, send a notice to support@bandbliss.com that identifies the work, the location of the allegedly infringing material, your contact information, and a statement made in good faith that the use is not authorized. We will review notices promptly and remove or disable access to material where appropriate.
6. Electronic Signatures
The Service lets organizations collect electronic signatures on their own documents, such as waivers, releases, and codes of conduct. By signing a document in BandBliss, you consent to sign electronically, and you agree that typing your legal name constitutes your signature with the same effect as a handwritten one. A parent or legal guardian may sign on behalf of a minor member and must indicate their relationship when doing so.
BandBliss facilitates the signing process and stores the resulting records, but it is not a party to any agreement between an organization and its members. The organization is solely responsible for the content, legal validity, and enforceability of the documents it asks members to sign.
7. Dues and Financial Records
BandBliss provides tools for tracking dues, transactions, budgets, and account balances. These tools are for record-keeping only. BandBliss does not collect, hold, or transfer money between members and organizations, and it is not a party to any payment arrangement between them. Financial reports generated by the Service reflect the data your organization entered and do not constitute accounting, tax, or legal advice.
8. AI-Assisted Features
Some features, such as music catalog assistance and the program builder, use artificial intelligence to generate suggestions. AI output may be incomplete or inaccurate. You are responsible for reviewing suggestions before saving or relying on them, and we make no warranty as to the accuracy of AI-generated content.
9. Subscription and Billing
Free accounts support up to 25 members at no charge. Paid plans are priced by ensemble size, as described on our Pricing page, and are billed monthly or annually. Subscriptions can be canceled at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.
If your organization exceeds the member limit of its current plan, the Service may place the organization in a read-only mode until the member count is reduced or the plan is upgraded. Your data remains intact and accessible during this time.
10. Your Data
You retain ownership of all data you enter into BandBliss. We do not sell your data to third parties. Administrators can export their organization's data at any time as CSV files from the Reports page, and organization owners can delete their entire organization and its data from the Settings page. You may also contact support for help with exports or deletion. See our Privacy Policy for details on how we handle personal information.
11. Suspension and Termination
We may suspend or terminate accounts that violate these terms, including repeated copyright infringement, misuse of email tools, or unlawful activity. Where practical, we will notify you and give you an opportunity to correct the issue first. Following termination, we will provide a reasonable window for you to export your data before it is deleted.
12. Limitation of Liability
BandBliss is provided "as is." We are not liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months prior to the claim.
13. Governing Law and Disputes
These terms are governed by the laws of the State of Colorado, without regard to its conflict of law principles. Before filing any claim, you agree to contact us and attempt to resolve the dispute informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Colorado.
14. Changes to Terms
We may update these terms from time to time. We will notify you of significant changes via email. Continued use of the Service after changes constitutes acceptance.
